By creating an account or making a purchase on PiksiProxy ("Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to all of these terms, you must not use the Service.

2. Service Description

PiksiProxy provides proxy services including residential, datacenter, ISP, IPv6, and mobile proxies as digital services activated immediately upon purchase.

3. Eligibility and Account Requirements

Age & Business Use

You must be at least 18 years old to use the Service. By using the Service, you represent that you act in a professional capacity.

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials, for all activities that occur under your account, for ensuring your account information is accurate, and for notifying us immediately of any unauthorized access or use.

Identity Verification (KYC)

PiksiProxy reserves the right to request identity verification at any time, particularly for new registrations, high-value transactions, suspicious activity, chargebacks, or payment disputes. Required documents may include your full legal name, residential address, government-issued photo ID (front and back), and a selfie video holding the ID. Users must complete verification within 7 business days or face account suspension, refund withholding, or permanent termination. Fraudulent submissions will result in immediate permanent account termination without refund and potential law enforcement reporting.

4. Purchases and Payment

Payment Processing

All purchases require valid payment information. By making a purchase, you represent that you have the legal right to use the payment method and authorize us to charge all applicable fees.

Pricing

Prices are displayed in applicable currencies at checkout. We reserve the right to modify pricing at any time without affecting already-confirmed orders.

Third-Party Processors

Payments are processed through third-party payment processors whose respective terms and privacy policies apply.

5. Immediate Performance and Waiver of Withdrawal Right

Nature of Digital Services

Services are activated immediately upon successful payment, providing instant access to proxy infrastructure.

Explicit Consent

By completing a purchase, you expressly request and consent to immediate service performance before any withdrawal period expires. You acknowledge and accept losing your withdrawal rights once services are fully performed, or proportionally for partial performance.

Waiver Confirmation

Consent occurs at checkout. Completing a purchase constitutes explicit agreement to immediate activation and acknowledgment of lost withdrawal rights.

6. Refund Policy

General Policy

All purchases are final and non-refundable once services are activated.

Service Non-Functionality

If the Service materially malfunctions due solely to issues on our end, you may submit a support request within 48 hours. We may remedy the issue, provide service credits, or offer a partial or full refund proportionally. To qualify, you must report the issue within 48 hours, document the verifiable problem, demonstrate it was not user-caused, and show it was beyond third-party or user-controlled factors.

Exclusions

No refunds apply to:

• Change of mind after purchase
• Incompatibility discovered after purchase
• Scheduled maintenance periods
• Violations of these Terms
• Account suspensions resulting from policy breaches
• Third-party failures outside our control
• Partial use of a subscription or plan
• Post-purchase price reductions

Refund Request Procedure

To request a refund, contact our support team with your account email, transaction reference, a detailed description of the issue with supporting evidence, and the date and time of first observation. We will respond within 5 business days. Our decision is final.

7. Payment Disputes and Chargebacks

Initiating a chargeback or payment dispute will immediately suspend all active services, hold your account balance, restrict further purchases, and may restrict associated accounts until the matter is fully resolved.

You agree to contact our support team before initiating any chargeback. Direct resolution attempts are required; chargebacks filed without prior contact constitute a breach of these Terms.

You acknowledge that chargebacks impose significant costs, and you agree to indemnify PiksiProxy for all costs resulting from unjustified or fraudulent chargebacks.

Account restoration after a favorable dispute resolution or withdrawal is not automatic. You must request reactivation, and PiksiProxy may decline at its sole discretion.

8. Subscriptions and Automatic Renewal

Subscriptions are billed in advance on a recurring basis per your selected billing cycle (e.g., monthly, quarterly, annually). Subscriptions automatically renew at the end of each period, and you authorize us to charge your payment method at the then-current rates.

You may cancel at any time via your account settings. Cancellation takes effect at the end of the current billing period. Access continues until the period ends; no refunds apply for remaining time.

We may modify subscription fees with reasonable notice. Continued use after changes constitutes acceptance. If you do not accept the changes, you must cancel before your next billing cycle.

9. Acceptable Use Policy

You agree not to use the Service for any of the following:

• Any unlawful purpose or in violation of any applicable law or regulation
• Unauthorized access to any system, network, or data
• Distribution of malware, viruses, or other harmful software
• Sending spam, phishing, or other unsolicited communications
• Harassment, abuse, or threats toward any individual or entity
• Infringement of intellectual property rights
• Exploitation of minors in any form
• Circumvention of security measures
• Interference with or disruption of the Service
• Violation of target website terms of service
• Unauthorized resale of the Service
• Sharing account credentials with unauthorized parties

You are responsible for ensuring that your use of the Service complies with all laws applicable in your jurisdiction. Violations may result in immediate suspension or termination without refund, and we reserve the right to report illegal activity to law enforcement.

10. Service Availability and Modifications

We strive to maintain high service availability but do not guarantee uninterrupted access. Services are provided on an "as available" basis.

Scheduled or emergency maintenance may temporarily affect availability. We will provide reasonable notice before scheduled maintenance when possible.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We are not liable for any modification, suspension, or discontinuation.

11. Intellectual Property

All content, features, functionality, trademarks, and intellectual property belong to PiksiProxy or its licensors and are protected by applicable intellectual property law.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended purposes.

You may not copy, modify, distribute, sell, lease, or create derivative works from any part of the Service without our express written permission.

12. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will meet your requirements, operate uninterrupted, be timely, secure, or error-free, that results will be accurate or reliable, or that errors will be corrected.

13. Limitation of Liability

To the maximum extent permitted by applicable law, PiksiProxy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits or revenue, data loss or breaches, business interruption, or loss of goodwill or reputation.

Our total liability for any claims arising from these Terms or the Service shall not exceed the amounts you have paid to PiksiProxy in the preceding 3 months.

These limitations apply regardless of the form of action (contract, tort, strict liability, or otherwise), even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless PiksiProxy, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, violation of any law or regulation, violation of third-party rights, or any content or data you transmit through the Service.

15. Account Termination

User Termination

You may close your account at any time by contacting support. Account closure does not entitle you to a refund of any fees.

Company Termination

We may immediately suspend or terminate your account without prior notice or liability for breach of these Terms, prohibited activities, legal requirements, service discontinuation, fraud, chargeback abuse, multiple account detection, or at our sole discretion.

Effects of Termination

Upon termination, your access to the Service ceases immediately. No refunds apply for unused services or remaining periods. Provisions that by their nature should survive termination will continue in effect.

16. Communications

By using the Service, you consent to receiving electronic communications from us, including service announcements, administrative messages, and promotional materials. You may opt out of promotional communications at any time by using the unsubscribe link or contacting support.

17. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk.

18. Dispute Resolution

Before initiating any formal proceedings, you agree to first contact our support team to attempt to resolve the dispute informally. Resolution attempts should occur within 30 days.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Waiver

The waiver of any term or condition shall not constitute a continuing waiver. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

21. Entire Agreement

These Terms of Service, together with our Privacy Policy and any other referenced policies, constitute the entire agreement between you and PiksiProxy regarding the Service, superseding all prior agreements and understandings.

22. Amendments

We reserve the right to modify these Terms at any time. Changes take effect upon posting to our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. PiksiProxy may assign its rights and obligations without restriction.

24. Force Majeure

PiksiProxy shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
